i have set the default upload method to flash but when my non admin users click upload they are presented with the flash uploader.... how can i set the default uploader for them to be html?

This setting is only for the administration.

This is why it is called
$admin_default_upload_method
and it's in TWG Admin section!

Frontend users can only use the flash because the whole rights management is not implemented in html

and here again there comes the 3 mb limitation.

is there any workaround this for the non admin users?

No - The flash has to be registered.

But you can of course implement a html upload form and include your own version. Can be easily done in a couple of days.
